482 & 494 Visa Sponsorship Agreements
This service is for Australian businesses who require their own Standard Business Sponsorship (SBS) to employ 482 and/ or 494 visa holders directly.

There are three (3) stages in sponsoring an employee from overseas under the 482 and/ or 494 visa, all of which JADE VISA can help you with.
1. Employer applies for a standard business sponsorship agreement, i.e. in other words a “sponsor license”. The Australian business must:
- Prove that you are an actively operating business in Australia
- Declare that you have a strong record/ commitment to employing local labour; and
- Have no adverse information regarding your business.
Once you have been granted the “sponsor license” your business can nominate a specific employee who you intend to hire. The job offer must be for an “occupation in need” by Australia, i.e. on the list of occupations by the Department of Home Affairs.
2. “Licensed” Sponsor (the Employer) applies for nomination, i.e. an employee to fill a nominated job. The Australian business must:
- Prove attempts to recruit staff locally
- Prove that the nominated employment position is genuine; and
- Offer to pay a compliant salary (i.e. the higher of market rate and the set Temporary Skilled Migrant Income Threshold)
Following the approval of a nomination application the DOHA can assess the overseas worker’s visa application in which he/she must meet certain criteria to be eligible.
3. Employee applies for their visa in one of three streams
- Labour Agreement – this is for employers to source overseas skilled workers in accordance with a labour agreement with the Commonwealth, on the basis of a demonstrated need that cannot be met in the Australian labour market and standard visa programs are not available, with the capacity to negotiate a permanent residence option.
- Short-term Stream – this is for employers to source genuine temporary overseas skilled workers in occupations included on the Short-term Skilled Occupation List (STSOL) for a maximum of two years each time (or up to four years if an international trade obligation applies)
- Medium-term Stream – this is for employers to source highly skilled overseas workers to fill medium-term critical skills in occupations included on the Medium and Long-term Strategic Skills List (MLTSSL) or the Regional Occupations List (ROL) for up to four years (each time), with eligibility to apply for permanent residence after three years
At the time of lodging a TSS nomination application, employers will need to select an employment period of up to:
- 1 year or 2 years for the short-term stream (unless an international trade obligation applies-up to 4 years); and
- 1 year, 2 years, 3 years or 4 years for the medium-term or labour agreements stream.
